These terms govern your use of frostpepperlabs.com and any purchase you make through it. By using the site you accept them. If you do not accept them, please do not use the site.

FrostPepper Labs Inc., a corporation incorporated under the laws of Ontario, Canada. Contact details are at the foot of this page.

Using the site

You agree not to use the site to break the law, to interfere with its operation, to scrape it at a scale that degrades it for others, to attempt to gain unauthorised access to any system, or to reproduce our content commercially without permission. We may suspend access where we reasonably believe any of these is happening.

Accounts

You are responsible for keeping your password confidential and for activity under your account. Tell us immediately if you believe your account has been compromised. We may close an account that has been used fraudulently or abusively.

Products, pricing and availability

• All prices are in Canadian dollars unless stated otherwise, and exclude shipping and any applicable duties.
• Our runs are small and finite. Listing a piece is not a guarantee that it is available.
• We photograph our pieces accurately, but screens vary. Small colour differences between the photograph and the piece are not a defect.
• Technical claims — temperature ratings, membrane specifications, insulation weights — describe the piece under the test conditions stated. Real-world performance depends on layering, activity level, wind, moisture and individual physiology.

Orders

Your order is an offer to buy. A contract is formed when we send you a dispatch confirmation, not when you place the order or receive an order acknowledgement. We may decline or cancel an order — and will refund you in full — where a piece is unavailable, where a price or description was materially wrong, where we suspect fraud, or where we cannot lawfully ship to your address.

Pricing errors

If a piece is listed at an obviously incorrect price, we will contact you before dispatch and give you the choice of paying the correct price or cancelling for a full refund. We will not charge you the difference without your agreement.

Pre-orders

Our Pre-Order Terms form part of these terms and take precedence over these terms where they conflict.

Intellectual property

The FrostPepper Labs name, the faceted pepper mark, our product designs, photography, copy, and the design of this site are our property or licensed to us. You may not reproduce, distribute or create derivative works from them commercially without our written permission. You may share our content on social media with attribution.

Content you submit

If you send us photographs, reviews or other content, you keep ownership of it, and you grant us a non-exclusive, worldwide, royalty-free licence to use it in connection with our brand and marketing. You confirm you own it or have the right to give us that licence. We may remove any submission at our discretion.

Limitation of liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be excluded — including your rights under the Ontario Consumer Protection Act, 2002 and equivalent legislation elsewhere.

Subject to that, our total liability arising out of any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, loss of profit, or loss of opportunity.

Third-party links

Where we link to another site we do so for convenience. We do not control those sites and are not responsible for their content or their privacy practices.

Changes to these terms

We may update these terms. The version in force is the one published here at the time you place your order. Material changes will be posted with a new effective date.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes are subject to the exclusive jurisdiction of the courts of Ontario. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection rules of your own place of residence.

Severability

If any provision of these terms is found unenforceable, the rest remain in force.
